"Trust me it’s more complicated than you think" - Valuing a beneficial interest in a discretionary trust

When a spouse is named as a beneficiary of a discretionary trust, they do not possess legal ownership over the trust's assets, which may include corporate shares. This lack of control over the distribution of trust assets and income poses a significant challenge in valuing their beneficial interests during matrimonial disputes. What valuation standards should be applied in such cases? Although the "fair market value" might suggest that the beneficial interest has no monetary value, settlements frequently reach into the millions. Why is this the case? This engaging presentation, featuring two renowned lawyers specialized in family and estate law, will dive into the factors that influence these high-stake settlements outside of court. Attendees will gain insights into the role of valuators in assisting legal counsel, understanding both the potential and limitations of their contributions in these complex legal scenarios.

BVR RESOURCES: QUALITY CONTROL CHECKLIST FOR VALUATION REPORTS

Practical how-to articles from Business Valuation Update are included in our BVR portal (for access instructions, please click here and log in), including a new series on quality control (QC) for valuation engagements. According to a BVR survey, QC is the #1 issue at valuation firms. The series starts with How to Review a Report’s Valuation Methodology, which offers a short checklist of questions for a QC reviewer to consider for the income, market, and asset-based approaches, as well as the excess earnings method. Top tip: “Ideally, someone other than the expert who prepared the valuation should do this.”

This series may be extra helpful for those who are using the latest International Valuation Standards (available on our website here), which require valuation process quality controls (see IVS 100 Valuation Framework, paragraph 20).
