In this mock arbitration, a family law lawyer, an arbitrator and a CBV will demonstrate what a CBV can expect in cross-examination in a typical family law case.
Employee compensation in the form of Employee Stock Options, Performance Shares and/or Restricted Stock Units have been recognized in Ontario Courts to fall under the Family Law Act’s definition of property even though they may be contingent in nature. As a result their value is usually considered and divided prior to vesting. When these units or options vest, the question of what amount should be considered as income for support purposes must be assessed. In this session an experienced CBV brings clarity to the overlapping issues of value in property, income inclusion and identifying possible “double-dipping”.
